Alberta > Law-Related Services > Alternative Dispute Resolution
Alternative dispute resolution has always implied that it is a choice of dispute resolution process’ that is an alternative to litigation. It has become more of a reality in recent times to refer the ADR processess as “ Appropriate dispute resolution processes “ implying that in a conflict situation one would choose the dispute resolution process that is appropriate for that dispute. The appropriateness is of course determined after the dispute is analyzed in more detail. It may very well be that litigation may be the selected dispute resolution process after detailed investigation. The other choices are mediation, facilitation, negotiation, all involving a dispute resolution process where both parties have addressed their needs, and concerns. Arbitration involves a third party hearing all the evidence and then issuing a binding award. Each ADR process has its benefits, and advantages. What we do realize is that conflict and disputes need to be addrressed , there are several processess available to address them, and we all realize that there is a better way to solve conflict.
